As a part of the probate process, the executor (or administrator) of the estate must settle an outstanding debts your loved one owed. To allow creditors to file any claims for these debts, a notice must be published in a local newspaper addressed to creditors, indicating that your loved one’s estate is going through probate.

State laws can differ and depending on your state, this notice may need to be left posted for several weeks. By state law, creditors are required to bring claims within a specific time determined by each state.

What to include in the notice

  • Name of the executor and their contact info (or the name and contact info for the attorney representing the estate)
  • Your loved one’s full name (including maiden name) and address
  • Date of death
  • Deadline by which any claims should be brought forward
